Nullification of Standing Rule - Permit Electronic County Executive Committee Meetings

WHEREAS, this Standing Rule was accepted by the illegitimately called MCRPTX CEC meeting on March 7, 2023, in direct violation of 2020-2022 By-Laws, Article VI - Meetings and Article XVI- Online Meetings; RPT Rule- 8J and Robert’s Rules of Order - 2:23.

WHEREAS, Article XVI only allows electronic meetings to be held by Sub-Committees by a majority vote of said committee and by the Steering Committee by a majority vote.

WHEREAS, a By-Laws change to allow electronic meetings to be held by the CEC would be required, not a Standing Rule that conflicts with the By-Laws.

WHEREAS, Article XIV – Amendment of By-Laws, Section 1. A written proposal of not less than 21 days prior to meeting, at which it shall be referred to the Rules Committee for consideration was not done.

WHEREAS, Article XIV, Section 2. All members of the CEC shall be emailed the Rules Committee report no less than 7 days prior to the scheduled meeting at which it shall be voted on proposed changes was not done.

WHEREAS, Article XIV, Section 3. Needed requirements of a yea vote of (2/3) of the members present when at least 50% of the members are voting at a scheduled CEC meeting was not achieved. At this meeting, 42 attendees/required 56 CEC members.

WHEREAS, RPT Rule-8 J states in the event of a stated emergency, as declared by the Chairman, a CEC meeting may be conducted by the use of electronic services. This was not a declared emergency meeting.

BE IT RESOLVED that the Standing Rule – To Permit Electronic CEC Meetings be declared null and void and that there will be no electronic meetings held by the CEC in part or whole.
