Censure Certain CEC Members Including Chairman Bryan Christ for Acting Without Authorization and Require the Return of All CEC Property
WHEREAS, a petition for a Special Meeting of the CEC on August 13 at the Lone Star Community Center called by the chairman of precinct 24 was signed by 19 members of the CEC; and
WHEREAS, the total membership of the CEC was 99 when the petition was presented; and
WHEREAS, Article VI, Section 2 of the bylaws provides that special meetings may be called by a written petition signed by 20% of the total membership; and
WHEREAS, 19 divided by 99 is 19.19%; and
WHEREAS, 19.19% is less than 20%; and
WHEREAS, in an email dated July 30, 2022, the County mistakenly stated that the petition satisfied the 20% petition rule of the bylaws; and
WHEREAS, no one, including the County Chairman is empowered to change the percentages required under the bylaws; and
WHEREAS, FAQ 5 on the Robert’s Rules of Order website clearly states that it is not possible to round up to satisfy a percentage requirement but that a specified percentage is a minimum such that there needs to be at least that percentage; and
WHEREAS, since the petition for August 13 Lone Star Community Center meeting was not signed by the required percentage of members, it was not possible for the CEC members assembled that day to conduct any CEC business, including electing Steering Committee members and other committee chairs; and
WHEREAS, since they could not have been elected that day, none of the actions taken by these members as Steering Committee members or Committee Chairs are authorized by the CEC; and
WHEREAS, by email dated Feb 21, 2023, the County Chair stated that a regular meeting of the CEC for March 7 was called by the Steering Committee at (specify earlier meeting): and
WHEREAS, since those Steering Committee members were not elected by the CEC, they could not have called a meeting of the CEC; and
WHEREAS, since the March 7 meeting was improperly called, no business of the CEC could have been transacted, and:
WHEREAS, certain members of the CEC have taken actions that were not authorized by the CEC, including disposing of CEC property from 310 Metcalf.
THEREFORE, THE CEC RESOLVES to censure the members who have acted without authorization of the CEC and require that all CEC property be returned.
